Harmos Horton Lusk advised NZX-listed Seeka on its acquisition of Opotiki Packing and Cool Storage (or OPAC), an integrated kiwifruit business operating in the Eastern Bay of Plenty. The acquisition was structured as an amalgamation and valued OPAC at $59 million. OPAC shareholders received Seeka shares in consideration for their OPAC shares. This transaction represents another milestone in Seeka’s history and was unanimously recommended by the boards of both Seeka and OPAC.
The firm advised Seeka throughout the acquisition process, including on the design and implementation of the transaction, due diligence processes, regulatory compliance and refinancing matters.
